En esos casos, lo correcto es efectuar un despido por causas objetivas y abonar a los afectados la indemnizaci\u00f3n de 20 d\u00edas por a\u00f1o de servicio. Si la extinci\u00f3n de contratos afecta a toda la plantilla y el n\u00famero de afectados es superior a cinco, debe tramitarse un despido colectivo.<\/p>\n<p>En estos casos \u2013y aunque parezca contradictorio al existir una causa de despido clara\u2013, si el despido contiene defectos de forma o la causa no est\u00e1 suficientemente acreditada, \u00e9ste puede llegar a declararse improcedente o incluso nulo. En los casos de nulidad proceder\u00eda la readmisi\u00f3n, pero puede ser que no sea posible porque la empresa ha cerrado. En este supuesto:<\/p>\n<ul>\n<li>La relaci\u00f3n laboral se declarar\u00e1 extinguida y el trabajador tendr\u00e1 derecho a percibir la indemnizaci\u00f3n por despido improcedente; es decir, 33 d\u00edas de salario por a\u00f1o de servicio, con un m\u00e1ximo de 24 mensualidades. Adem\u00e1s, tendr\u00e1 derecho a los salarios de tramitaci\u00f3n devengados desde la fecha del despido hasta la fecha de la sentencia.<\/li>\n<\/ul>\n<ul>\n<li>Se procede del mismo modo si el despido se ha declarado improcedente y se ha optado por la readmisi\u00f3n.<\/li>\n<\/ul>\n<p>Esto puede darse, por ejemplo, en despidos de trabajadoras embarazadas o de empleados en reducci\u00f3n de jornada por guarda legal o en excedencia por cuidado de hijos. En estos casos, cuando haya defectos formales en el despido o la empresa no acredite unas causas claras y exista impugnaci\u00f3n por parte del afectado, si la empresa cierra antes de que se notifique la sentencia, deber\u00e1 procederse a la extinci\u00f3n de la relaci\u00f3n con la indemnizaci\u00f3n de 33 d\u00edas y los salarios de tramitaci\u00f3n.
